In Mexico, only one union has the right and privilege to negotiate, on behalf of the workers, the conditions under which work must be performed. For this reason, the certificate of representativeness is a critical document that accredits a union as the representative of the interests of the majority of workers within a company or establishment.
Understanding the importance of the certificate of representativeness and the process a union must follow to obtain it is crucial because it allows the union to:
- Negotiate working conditions and enter into a collective bargaining agreement (CBA) with the employer; and
- Exercise the right to strike by issuing a notice if the employer refuses to enter into a CBA with the union.
